    How the estimate works

    • Lower end: 1 week of base pay per year of service. It matches New Jersey’s legal minimum for covered mass layoffs and is a common floor in company policies.
    • Higher end: 2 weeks per year, plus 2 weeks for managers and 4 for directors and above, who often negotiate more.
    • Weekly pay: annual base salary divided by 52, before taxes. Bonuses, equity and benefits are not included.

These are rules of thumb, not legal entitlements. Your actual package depends on your contract, your company’s policy and what you negotiate. Read how to negotiate severance before you sign.

    FAQ

Is severance pay required by law?

Not under federal law: the U.S. Department of Labor says there is no requirement in the Fair Labor Standards Act for severance pay. New Jersey is an exception for covered mass layoffs, with 1 week of pay per full year of service.

    How much severance is normal?

It depends on the company and your contract. A common way to frame a negotiation is 1 to 2 weeks of base pay per year of service. Large tech companies have offered more: Meta and Google announced 16 weeks plus 2 weeks per year of service.

    How is severance calculated?

Usually as a number of weeks of base pay, often tied to years of service. Weekly pay is your annual base salary divided by 52. Bonuses, equity and benefits are negotiated separately.

Can I get unemployment if I receive severance?

In many states you can, but severance can delay or reduce benefits depending on state rules. Apply as soon as your job ends and report the severance.
